A PI central to the court case initiated by the Duke of Sussex and several claimants targeting the publishing group of the Daily Mail has claimed his autograph on an prior testimonial document was a “counterfeit”, the high court has been told.

The investigator, associated with the gravest allegations of illicit data collection made by multiple well-known personalities including Elton John and the activist, withdrew his alleged confession, declaring it was “wholly fabricated”.

Context of the Alleged Confession

Burrows had supposedly asserted in a testimonial from 2021 that he and his associates obtained data by breaching voice messages, tapping home telephones and bugging automobiles. He also reportedly claimed he had operated on behalf of the Mail on Sunday.

The publishing group is charged by the plaintiffs of conducting or hiring for illegal acts such as engaging private investigators to position surveillance equipment inside cars, manipulating access to private records and gaining entry to personal discussions. The defendant denies the allegations and is defending the case.

Withdrawal and New Allegations

Five of the plaintiffs have informed the court they initiated the legal action against the publisher based on evidence seemingly gathered by Burrows.

Burrows had before retracted his alleged testimony in last year. In a new 30-page witness statement made on a recent date, and disclosed by the court on this week, he reiterated his rejection, stating he had never engaged in any illegal activity on behalf of the company.

In the new statement, he stated he did “fail to acknowledge” the alleged testimonial on 16 August 2021”. He said he thought it was “drafted by someone else”, that the “signature is not mine”, and did dispute the truthfulness of much of the material”.

The investigator stated: “I do not recognise the earlier witness statement of that date and I think that my autograph on that paper is a fabrication. Much of it is not composed in my type of language. Additionally, the substance of the statement are mostly inaccurate.”

He stated further that he had “at no time” carried out tasks for the Mail On Sunday or the Daily Mail, with the exception of one assignment involving Sir Richard Branson that was free from any unlawful act”.

Context of the Initial Statement

The witness stated he was on strong medication after a significant attack, and drinking heavily, when he was contacted by Graham Johnson, a whistleblower convicted of phone hacking, who desired assistance with inquiry on allegations of interception against media outlets.

He was connected to a contact, an individual, who was identified as a “paralegal” and was compensated a sum a instance for guidance.

His testimony claimed he was advised allegations targeting newspapers were expected to settle out of court, as the papers did not want the exposure or cost of a legal proceeding, and were portrayed to him as a “flawless fraud” and a “gravy train”.

Burrows, who said he had ceased operating for publications in that year, stated he had stated to Johnson on numerous occasions that the publisher were not one of my customers”.

Current Legal Status

The witness was at first a witness for the group, which features Simon Hughes and others, but is now the topic of debates about whether or not he will be asked to testify as a witness for the court case.

Antony White KC, for the defendant, requested the judge to permit him to question the witness, while David Sherborne, for the group, made an request to consider his evidence as rumor.

The presiding officer allowed the barrister seven days to decide if he desired to request a witness summons to call Burrows, and told him if Burrows gave evidence that was inconsistent with the evidence they had obtained, then he could apply to treat him as “adverse”.

A subsequent preliminary proceeding in the legal action is projected to take place before the close of the calendar.
