Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.

In her decision, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The court challenge center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.

The judge, who was overseeing his petition to removal in a federal court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
